1. This Campaign
a)The Campaign applies solely to the recruitment of the Gardener/Groundsman position advertised. No Reward shall be payable in respect of any other role or position.
2. Participation and Registration
a)To participate in the Campaign, you must register via the official Campaign page hosted on the Referral Factory platform and obtain your own unique referral link.
b)By registering, you confirm that you are at least 18 years of age.
c)Only one referral link will be issued per individual. Attempting to obtain multiple links is prohibited and will result in disqualification.
d)Referrals made outside the Referral Factory tracking platform — whether by email, verbal introduction, or any other means not captured by the platform — are not eligible for the Reward.
3. Eligibility
The following persons are not eligible to receive any part of the Reward:
a)employees or workers engaged at or in connection with Honiley Hall;
b)family members of any such employee or worker;
c)the Successful Candidate;
d)any person acting fraudulently or in bad faith;
e)any contractor, consultant, agent, or third party engaged in any capacity at or in connection with Honiley Hall;
f)any family member of such contractor, consultant, agent, or third party.
ITYM reserves the right to request reasonable evidence of a Participant's eligibility before making any payment.
4. How the Referral Chain Works
a)The Referral Factory platform records the Referral Chain, tracing each new user back to the originating sharer.
b)The maximum depth of any Referral Chain is three levels.
c)Only one Reward is payable per Successful Candidate.
d)Where more than one Participant claims to have referred the same individual, only the Referral Chain associated with the unique referral link used by that individual when submitting their application via the Referral Factory platform shall be recognised.
e)Any prior introduction, communication, or referral not captured and recorded through the Referral Factory platform shall be disregarded and shall not give rise to any entitlement to a Reward.
f)ITYM shall not consider or adjudicate upon any claim based on who first introduced or referred a candidate outside of the tracked platform.
g)The records generated by the Referral Factory platform shall be relied upon by ITYM as the authoritative and conclusive record of referral activity.
5. Reward Structure
a)The Reward is five hundred pounds (£500) in total, distributed across the Payment Period in four equal monthly instalments of £125 each.
b)Under this Campaign, the full Reward of £500 is payable to the single Participant whose unique referral link was used directly by the Successful Candidate when submitting their application.
c)Allocation of the Reward shall be as set out within the Campaign materials.
For the avoidance of doubt:
d)there is only one Vacancy under this Campaign;
e)there is only one total Reward of £500;
f)no additional, duplicate, or alternative rewards shall arise under any circumstances.
g)The Reward shall be allocated strictly in accordance with the tracked Referral Chain.
h)The Reward is a gross payment, and Participants are solely responsible for declaring any payment received and for any tax or national insurance liabilities arising.
6. Conditions for Payment
a)No part of the Reward is payable unless and until the Successful Candidate commences engagement in the Vacancy.
b)The first monthly instalment will be paid on or before the 14th day of the calendar month following the Successful Candidate's confirmed start date, with subsequent instalments paid monthly thereafter.
c)If the Successful Candidate's engagement ends for any reason during the Payment Period, all further instalments shall cease immediately.
d)Each monthly instalment is conditional on the Successful Candidate remaining in continuous employment at the date it falls due. For the avoidance of doubt, continuity of employment for this purpose means attendance only — performance quality is explicitly excluded as a condition.
e)Any instalment due in respect of the calendar month in which engagement ends shall not be paid.
f)Any instalments already paid shall not be recoverable, provided that the referral was made in good faith and in compliance with these Terms and Conditions.
7. Payment Process
a)Upon confirmation that the Successful Candidate has accepted an offer of engagement, ITYM will contact all eligible Participants.
b)Participants must provide their full name and valid bank account details before payment can be made.
c)Payments will be made by bank transfer only.
d)ITYM accepts no responsibility for payments made to incorrect details provided by a Participant.
e)Participants must provide valid bank details within 28 days of notification. Failure to do so may result in forfeiture of the relevant instalment.
8. Recruitment Decisions
a)The decision as to whether any candidate is appointed to the Vacancy rests solely with ITYM.
b)ITYM is under no obligation to appoint any candidate introduced through the Campaign.
c)All determinations made by ITYM in connection with the Campaign, including the identity of the Successful Candidate, the structure of any Referral Chain, eligibility of Participants, and allocation of the Reward, shall be final, conclusive, and binding.
d)ITYM shall have absolute discretion and shall not be required to provide reasons or enter into correspondence in relation to any such decision.
9. General Provisions
a)ITYM reserves the right to amend, suspend, or withdraw the Campaign at any time.
b)Referral Factory acts solely as a technology provider and has no involvement in the operation, promotion, funding, or discretionary decision-making of the Campaign.
c)ITYM accepts no liability for any failure, interruption, delay, inaccuracy, omission, or error in the operation of the Referral Factory platform or any referral link, howsoever caused.
d)Participants acknowledge that ITYM shall not be responsible for any loss, claim, or dispute arising from or connected with any such failure, inaccuracy, or omission.
e)Nothing in these Terms and Conditions shall create any partnership, joint venture, agency, employment, or other relationship between ITYM and any Participant.
f)Participants act solely on their own behalf and have no authority to act for, represent, or bind ITYM in any way.
g)Participation in the Campaign is on a one-off, voluntary basis only and does not create any ongoing business relationship or expectation of future engagement, referral rights, commission, or reward.
h)These Terms and Conditions constitute the entire agreement between ITYM and each Participant in relation to the Campaign and supersede all prior discussions, communications, representations, or arrangements, whether written or oral.
i)Each Participant acknowledges that they have not relied on any statement, representation, assurance, or warranty other than as expressly set out in these Terms and Conditions.
j)Nothing in these Terms shall limit or exclude liability for fraud.
k)If any provision of these Terms and Conditions (or part of any provision) is found by any court or competent authority to be invalid, unlawful, or unenforceable, that provision or part-provision shall, to the extent required, be deemed deleted and, in any event, the validity and enforceability of the remaining provisions shall continue in full force and effect.
l)Where any such provision can be modified so as to be valid and enforceable, it shall be deemed to be modified to the minimum extent necessary to make it valid and enforceable.
10. Governing Law and Jurisdiction
a)These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the law of England and Wales.
11. Dispute Resolution
a)Any dispute arising out of or in connection with these Terms and Conditions or the Campaign shall first be referred to good faith discussion between the parties.
b)If the dispute is not resolved within 14 days, it shall be referred to a single arbitrator appointed by agreement between the parties or, failing agreement, appointed by the President of the Law Society of England and Wales.
c)The arbitration shall be conducted in England in accordance with the Arbitration Act 1996.
d)The arbitrator shall have the power to award costs, and unless the arbitrator determines otherwise, costs shall follow the event, with the unsuccessful party bearing the reasonable costs of the successful party, including the arbitrator's fees.
